INTRODUCTION 15 This 42 U.S.C. § 1983 civil rights action is before the Court on Defendantsâ Motion for 16 Summary Judgment Pursuant to Fed. R. Civ. P. 56. Dkt. #40. Plaintiffs contend that the case 17 should not be dismissed. Dkt. #47. Having considered the matter, the Court grants Defendantsâ 18 motion and dismisses the action. 19 II. BACKGROUND 20 The facts relevant to Plaintiffsâ claims are straight-forward and not subject to dispute.1 21 Plaintiffs Steven Kayser and Gloria Young lived in rural Whatcom County. The Court finds the following statement 24 of fact consistent with the record when viewed in the light most favorable to Plaintiffs. 1 Adams, a process server, went to Plaintiffsâ property to serve process on Mr. Kayser. Plaintiffs 2 were alarmed that an unknown man was on their property and approached Mr. Adams. Mr. 3 Adams ultimately served papers upon Mr. Kayser, who then demanded that Mr. Adams leave the 4 property. When Mr. Adams did not depart the property fast enough, Mr. Kayser retrieved a 5 shotgun, and when Mr. Adams still did not move to leave, Mr. Kayser discharged his shotgun 6 twice, into the air. Prompted to action, Mr. Adams moved to his car and, while inside the car, 7 made a gesture that Mr. Kayser believed indicated that Mr. Adams possessed a gun. Mr. Kayser 8 again fired the shotgun into the air and Mr. Adams subsequently left the property. 9 Following these events, the police were called, with Mr. Kayser ultimately being arrested 10 by the Whatcom County Sheriffâs Office (âWCSOâ) and charged with assault in the second 11 degree while armed with a deadly weapon. The Whatcom County Prosecuting Attorneyâs Office 12 (âWCPAOâ) pursued the charges, led at all relevant times by Defendant David S. McEachran, 13 Whatcom Countyâs elected Prosecuting Attorney. Nothing in the record demonstrates that Mr. 14 McEachran was directly involved in Mr. Kayserâs prosecution and the case was instead handled 15 by a deputy prosecutor within the WCPAO. Mr. Kayser proceeded to trial and was found guilty 16 in November, 2013. Mr. Kayser appealed his conviction and won a reversal in 2016 because the 17 trial court had committed an evidentiary error. The case was remanded back to the state trial 18 court for further proceedings and Whatcom County elected to retry Mr. Kayser. 19 Mr. Kayserâs defense attorney made public records requests following remandâ 20 presumably for records related to the alleged victim Mr. Adamsâto Whatcom County and 21 several nearby jurisdictions. As a result of the public records requests, Mr. Kayserâs defense 22 attorney received records to four incidents involving Mr. Adams: 23 ï· A WCSO report detailing an alleged April 6, 2010, assault by Mr. Adams on a property 24 owner in the course of Mr. Adams serving process. See Dkt. #42 at 7â19. 1 ï· A WCSO report detailing an alleged September 5, 2010, assault on Mr. Adams by a 2 property owner who felt threatened in the course of Mr. Adams serving process and an 3 October 15, 2010, letter from the Whatcom County Prosecuting Attorneyâs Office 4 explaining its decision not to pursue charges against the property owner. Id. at 21â32. 5 ï· A WCSO report detailing an alleged October 3, 2015, assault on Mr. Adams by a property 6 owner who was unhappy with his presence on her property. Id. at 34â37. 7 ï· An Anacortes Police Department report detailing a January 2, 2016, incident where Mr. 8 Adamsâ presence on private property caused an occupant to call the police. Id. at 39â45. 9 These reports broadly demonstrated that Mr. Adams had frightened other individuals when he 10 had entered private property to serve process. Believing that the testimony may support a claim 11 of self-defense, Mr. Kayserâs defense attorney sought to have the individuals involved testify at 12 Mr. Kayserâs second trial. The WCPAO opposed Mr. Kayserâs request. When the trial court 13 granted Mr. Kayserâs request just before the second trial was to occur, on October 31, 2017, the 14 WCPAO dismissed all charges against Mr. Kayser, with prejudice. 15 Several years after the dismissal of Mr. Kayserâs criminal charges, Plaintiffs filed this 16 action in the Washington State Superior Court for Whatcom County. Plaintiffs sued Whatcom 17 County, Mr. McEachran, and the deputy prosecutor who handled Mr. Kayserâs case, alleging (1) 18 due process violations, (2) Whatcom Countyâs liability for the constitutional violation under 19 Monell and on the basis of Whatcom Countyâs policy, custom, or failure to train, and (3) claims 20 for malicious prosecution. Dkt. #1-1. 21 Defendants removed the action to this Court where it was initially assigned to the 22 Honorable John C. Coughenour, United States District Court Judge. On Defendantsâ motion, 23 Plaintiffsâ complaint was dismissed with leave to amend. Dkt. #14. Plaintiffs filed an amended 24 complaint re-alleging the same claims and Defendants again sought dismissal, which Judge 1 Coughenour granted. Dkt. #15 (Plaintiffsâ amended complaint); Dkt. #17 (Defendantsâ motion 2 to dismiss); Dkt. #25 (Courtâs order granting motion to dismiss). 3 On appeal, the Ninth Circuit Court of Appeals affirmed the dismissal of Plaintiffsâ § 1983 4 claims to the extent they were based on theories of Whatcom Countyâs customs or practices and 5 on its alleged failure to adequately train its employees.2 Dkt. #30. The Ninth Circuit reversed 6 this Court as to Plaintiffsâ § 1983 due process claims against Defendant Whatcom County and 7 Defendant David McEachran, finding that Plaintiffs had 8 alleged that Whatcom Countyâs official written policy erroneously provided that âonly evidence for the possible impeachment of government employeesâ had to 9 be disclosed under Brady v. Maryland, 373 U.S. 83 (1963), and that the Countyâs implementation of this policy violated [Plaintiffsâ] constitutional rights. These 10 allegations are sufficient to state a claim under [42] U.S.C. § 1983 against [Defendants Whatcom County and Mr. McEachran] for constitutional injuries 11 inflicted by the implementation of a local governmentâs official policies. 12 Dkt. #30 at 2 (citing Monell v. Depât of Soc. Servs., 436 U.S. 658 (1978)). 13 On remand, Judge Coughenour recused himself and the matter was assigned to the 14 undersigned. Dkt. #32. Defendants subsequently answered Plaintiffsâ amended complaint. 15 Dkt. #34. Defendants now seek summary judgment in their favor and dismissal. Dkt. #47. 16 III. DISCUSSION 17 A. Legal Standard 18 Summary judgment is appropriate where âthe movant shows that there is no genuine 19 dispute as to any material fact and the movant is entitled to judgment as a matter of law.â FED. 20 R. CIV. P. 56(a); Anderson v. Liberty Lobby, Inc., 477 U.S. 242, 247 (1986). Material facts are 21 those which might affect the outcome of the suit under governing law. Anderson, 477 U.S. at 22 248. In ruling on summary judgment, a court does not weigh evidence to determine the truth of 23 2 Plaintiffs appear to have abandoned their malicious prosecution claims on appeal. See Kayser 24 v. Conoco, 2 Inc., 41 F.3d 547, 549 (9th Cir. 1994) (citing Federal Deposit Ins. Corp. v. OâMelveny & Meyers, 3 969 F.2d 744, 747 (9th Cir. 1992)). 4 The non-moving party must present significant and probative evidence to support its 5 claim or defense. Intel Corp. v. Hartford Accident & Indem. Co., 952 F.2d 1551, 1558 (9th Cir. 6 1991). âThe mere existence of a scintilla of evidence in support of the [non-moving partyâs] 7 position will be insufficient; there must be evidence on which the jury could reasonably find for 8 the [non-moving party].â Anderson, 477 U.S. at 251. Neither will uncorroborated allegations 9 and self-serving testimony create a genuine issue of material fact. Villiarimo v. Aloha Island Air, 10 Inc., 281 F.3d 1054, 1061 (9th Cir. 2002); T.W. Elec. Serv. v. Pac. Elec. Contractors Assân, 809 11 F. 2d 626, 630 (9th Cir. 1987). Rather, to survive a motion for summary judgment, the non- 12 moving party must make a âsufficient showing on [each] essential element of her case with 13 respect to which she has the burden of proof.â Celotex Corp. v. Catrett, 477 U.S. 317, 323 (1986). 14 On summary judgment, the Court views the evidence and draws inferences in the light 15 most favorable to the non-moving party. Anderson, 477 U.S. at 255; Sullivan v. U.S. Depât of 16 the Navy, 365 F.3d 827, 832 (9th Cir. 2004). However, where the non-moving party fails to 17 properly support an assertion of fact or fails to properly address the moving partyâs assertions of 18 fact, the Court will accept the fact as undisputed. FED. R. CIV. P. 56(e). As such, the Court relies 19 âon the nonmoving party to identify with reasonable particularity the evidence that precludes 20 summary judgment.â Keenan v. Allan, 91 F.3d 1275, 1278â79 (9th Cir. 1996) (quotation marks 21 and citations omitted). The Court need not âcomb through the record to find some reason to deny 22 a motion for summary judgment.â Carmen v. San Francisco Unified Sch. Dist., 237 F.3d 1026, 23 1029 (9th Cir. 2001); Keenan, 91 F.3d at 1279 (the court will not âscour the record in search of 24 a genuine issue of triable factâ). 1 B. Plaintiffsâ § 1983 Claims 2 A § 1983 claim exists where defendants, acting under the color of state law deprived 3 plaintiffs of rights secured by the Constitution or federal statutes. See Pistor v. Garcia, 791 F.3d 4 1104, 1114 (9th Cir. 2015). Here, Plaintiffs pursue claims against Whatcom County and Mr. 5 McEachran, in his official capacity as Whatcom Countyâs elected Prosecuting Attorney. Both 6 are persons against whom § 1983 claims may be brought. See Jackson v. Barnes, 749 F.3d 755, 7 764 (9th Cir. 2014); Monell, 436 U.S. at 690 n.55. The parties make no distinction between the 8 claims and indeed there is no difference between a claim against Whatcom County and a claim 9 against Mr. McEachran in his official capacity. See Kentucky v. Graham, 473 U.S. 159, 165â66 10 (1985) (âOfficial-capacity suits . . . âgenerally represent only another way of pleading an action 11 against an entity of which an officer is an agent.â) (citing Monell, 436 U.S. at 690 n.55). 12 Local governments âmay not be held liable for a § 1983 violation under a theory of 13 respondeat superior for the actions of its subordinates.â Castro v. Cty. of Los Angeles, 833 F.3d 14 1060, 1073 (9th Cir. 2016). Rather, the claim must rest on an affirmative action taken by the 15 local government. See Bd. of Cnty. Comm'rs of Bryan Cnty., Okl. v. Brown, 520 U.S. 397, 405 16 (1997) (âIn any § 1983 suit . . . the plaintiff must establish the state of mind required to prove the 17 underlying violation. Accordingly, proof that a municipalityâs legislative body or authorized 18 decisionmaker has intentionally deprived a plaintiff of a federally protected right necessarily 19 establishes that the municipality acted culpably.â). That is, âa plaintiff must show that a âpolicy 20 or customâ led to the plaintiff's injuryâ and that âthe policy or custom of a municipality âreflects 21 deliberate indifference to the constitutional rights of its inhabitants.ââ Id. (citing Monell, 436 22 U.S. at 694; City of Canton v. Harris, 489 U.S. 378, 392 (1989)). This is often accomplished by 23 24 1 (1) pointing to an express policy,3 (2) establishing a custom or practice that is akin to a policy,4 2 or (3) establishing that the entityâs inaction is akin to affirmative adoption of a policy.5 See 3 Connick v. Thompson, 563 U.S. 51, 61 (2011) (âOfficial municipal policy includes the decisions 4 of a governmentâs lawmakers, the acts of its policymaking officials, and practices so persistent 5 and widespread as to practically have the force of law. These are âaction[s] for which the 6 municipality is actually responsible.ââ) (internal citations omitted, alteration in original). 7 Here, and of primary importance, the Court notes that the Ninth Circuit affirmed the 8 Courtâs earlier dismissal of Plaintiffsâ claims to the extent they were premised on Defendantsâ 9 customs or practices or on a failure of Defendants to train their employees (a policy of inaction). 10 1. The Court Will Assume That Mr. Kayserâs Constitutional Rights Were Violated 11 Plaintiffs maintain that Defendants violated Mr. Kayserâs constitutional rights by failing 12 to disclose exculpatory evidence in violation of their obligations under Brady and its progeny. 13 See Brady v. Maryland, 373 U.S. 83, 88 (1963) (setting forth a violation of the constitutional 14 right to due process). Plaintiffs further argue that this Court and the Ninth Circuit have already 15 impliedly found that Defendantsâ actions violated Brady principles. Dkt. #47 at 9â13. 16 Defendants appropriately object, noting that the prior orders were formulated under the more 17 forgiving pleading standards by which motions to dismiss are judged. Dkt. #48 at 2. Further 18 discussion on this point is not necessary. 19 As set out in the Courtâs second order dismissing Plaintiffsâ complaint, a plaintiff alleging 20 a Brady violation must prove that: âThe evidence at issue [is] favorable to the accused, either 21 22 3 E.g. Monell, 436 U.S. 658 (1978). 23 4 E.g. City of St. Louis v. Praprotnik, 485 U.S. 112 (1988). 24 5 E.g. Connick v. Thompson, 563 U.S. 51 (2011). 1 because it is exculpatory, or because it is impeaching; that evidence [was] suppressed by the 2 State, either willfully or inadvertently; and [that] prejudice . . . ensued.â Dkt. #25 at 3 (quoting 3 Strickler v. Greene, 527 U.S. 263, 281â82 (1999)) (alterations by this Court). 4 The Court will not dwell on the issue. Plaintiffsâ hurdle is not an insignificant one. See 5 Smith v. Almada, 640 F.3d 931, 939 (9th Cir. 2011) (âstrictly speaking, there is never a real 6 âBrady violationâ unless the nondisclosure was so serious that there is a reasonable probability 7 that the suppressed evidence would have produced a different verdictâ) (quotation marks and 8 citations omitted). But at the end of the day, Mr. Kayser proceeded to his first trial without the 9 benefit of the evidence at issue, the evidence did tend to support Mr. Kayserâs defense, and the 10 charges were dismissed with prejudice when the evidence was ruled admissible. For the sake of 11 this motion, and because Plaintiffsâ claims fail for other reasons, the Court accepts Plaintiffsâ 12 argument and finds that there is at least a genuine dispute as to material facts with regard to 13 whether a Brady violation occurred. 14 2. Any Brady Violation Was Not Caused by a County Policy 15 Plaintiffs must next establish that the constitutional violation resulted from Defendantsâ 16 policy and that the policy reflected deliberate indifference to constitutional rights. See Connick, 17 563 U.S. at 60 (plaintiffs must prove that an âaction pursuant to official municipal policyâ caused 18 their injury). Again, the Ninth Circuit held that dismissal was inappropriate specifically because 19 Plaintiffs âalleged that Whatcom Countyâs official written policy erroneously provided that âonly 20 evidence for the possible impeachment of government employeesâ had to be disclosed under 21 [Brady, 373 U.S. 83].â Dkt. #30 at 2. But Plaintiffs do not present evidence of a specific policy 22 that led to the constitutional violation upon which they base their claims. 23 Mr. Kayser was charged in 2010, and his jury trial took place on November 18â21, 2013, 24 resulting in his conviction. Dkt. #44 at 55â62. At the relevant times, WCSO had not formally 1 adopted a policy related to Brady obligations and did not adopt a formal policy until September 2 16, 2014. Dkt. #41 at 5â9. As for WCPAO, Mr. McEachran testifies that the office âoperated 3 under the model policy promulgated by the Washington Association of Prosecuting Attorneys 4 [(âWAPAâ)].â Dkt. #43 at ¶ 3. The office adopted a formal policy no earlier than June 19, 2013. 5 Id. at 6â12. Plaintiffs do not present evidence that any formal policy existed before that date. 6 As to the WCPAO policy, Plaintiffs are unable to point to a specific portion of the policy 7 that led to the constitutional violation on which they base their claims. In fact, Plaintiffs do not 8 point to any limiting language within the policy and do not argue, let alone establish, that 9 anything within the policy limits a prosecutorâs obligations under Brady. On the Courtâs review, 10 the policy appears consistent with Brady principles. 11 In fact, the purpose of the policy appears to the Court to be more limited in scope: âThis 12 written policy is designed to achieve compliance with [requirements related to the disclosure of 13 potential impeachment evidence for recurring investigative or professional witnesses], and to 14 foster county-wide uniformity in the way potential impeachment of recurring government 15 witness issues are resolved.â Id. at 7. The policyâs background section further notes that 16 prosecutors have an âaffirmative duty to disclose potentially exculpatory information to a 17 charged defendant.â Id. at 8. Similarly, the policy makes clear that â[p]rosecutors have âa duty 18 to learn of any [exculpatory] information known to the others acting on the governmentâs behalf 19 in the case, including the police.ââ Id. (quoting Kyles v. Whitely, 514 U.S. 419 (1995)). Similarly, 20 the policy specifies that Brady goes beyond impeachment evidence and that prosecutors have âan 21 affirmative duty to seek out certain impeachment information and a duty to disclose information 22 that may not impact the witnesses [sic] credibility.â Id. at 9. Having set forth the background 23 within which the policy exists, it then sets forth guidelines and processes on how WCPAO 24 planned to deal with a more limited subset of Brady materialâdisclosures related recurring 1 government witnesses. Again, the Court finds no language that limits a prosecutorâs obligations 2 under Brady, and Plaintiffs do not point to any. That the policy specifically addressed a smaller 3 galaxy within the Brady universe does not imply that prosecutors were free to destroy all other 4 galaxies in the Brady universe. 5 Plaintiffs argue that â[t]he policy at issue is Defendantsâ definition of Brady evidence that 6 must be disclosed to the defendant in a criminal prosecution.â Dkt. #47 at 13. Further, Plaintiffs 7 assert that âDefendantsâ post-20146 policies do not simply fail to ensure that all Brady evidence 8 is disclosed to criminal defendants; they actively direct government employees to disclose only 9 potential impeachment information of government employees. Defendantsâ post-2014 policies 10 are thus appropriately characterized as policies of action.â Id. at 14. Notably absent is any 11 citation to the language upon which Plaintiffsâ assertion is based. 12 Plaintiffsâ unsupported arguments reveal that Plaintiffs are attempting to reargue claims 13 that have already been dismissedâclaims premised on Defendantsâ alleged failures to adequately 14 train prosecutors on their Brady obligations. Plaintiffs do not take issue with any material in the 15 WCPAOâs policy or support the manner in which it led to the alleged violation of Mr. Kayserâs 16 constitutional rights. Plaintiffs simply complain that additional requirements could have been 17 set forth more explicitly in this, or another, policy.7 Even if these claims had not already been 18 dismissed, Plaintiffs do not point to any past pattern of conduct that could support a claim of 19 6 The Court believes Plaintiffs likely intended to refer to âpost-2013 policies.â The WCSO 20 adopted relevant policies in 2014, but this was after Mr. Kayser was convicted in possible violation of his due process rights. In the normal course, a policy enacted after a violation cannot 21 serve as a local governmentâs policy that led to the constitutional violation. The Court believes that Plaintiffs likely meant to refer to the WCPAOâs policy, which was adopted in 2013. Dkt. 22 #43 at 6â12. 23 7 â[A] plaintiff must show that the [local governmentâs] action was taken with the requisite degree of culpability and must demonstrate a direct causal link between the [local governmentâs] action 24 and the deprivation of federal rights.â Brown, 520 U.S. at 404. 1 inaction. See Brown, 520 U.S. at 407â08 (noting that âcontinued adherence to an approach that 2 [policymakers] know or should know has failed to prevent tortious conduct by employees may 3 establish the conscious disregard for the consequences of their actionâthe âdeliberate 4 indifferenceâânecessary to triggerâ the liability of local governments); Brown v. Lynch, 831 5 F.3d 1146, 1152 (9th Cir. 2016) (noting that failure to train claims need âevidence that 6 policymakers were aware or should have been aware of the serious risks posed by their failure to 7 actâ). Plaintiffs do not present any evidence that other similar constitutional violations had 8 occurred. 9 Plaintiffsâ argument that â[t]he policies of both offices, limiting Brady evidence to 10 potential impeachment of reoccurring/government witnesses, is patently unconstitutional,â does 11 not fare any better. See Dkt. #47 at 16. Plaintiffs point to nothing that establishes a constitutional 12 violation premised on a local governmentâs failure to have a policy that exhausts all of the myriad 13 situations in which Brady may be implicated. Plaintiffs do not point to an authority that even 14 requires a form policy related to Brady material. Surprisingly, Plaintiffs argue the opposite point 15 as well; that all of Defendantsâ employees âdemonstrated a basic understanding that Brady 16 requires them to disclose all exculpatory evidence to criminal defendants.â Dkt. #47 at 18; see 17 also Connick, 563 U.S. at 64â67 (noting that the extensive legal training of prosecutors and their 18 tendency to work collectively cuts against a theory of municipal liability founded on a single 19 foreseeable violation of Brady).8 Plaintiffs appear wholly unaware that this allegation alone cuts 20 sharply against their argument that the Defendants acted âwith âdeliberate indifferenceâ as to 21 [the] known or obvious consequencesâ of failing to adequately train their prosecutors. See 22 Brown, 520 U.S. at 407 (1997). 23 8 Surprisingly, neither party even cites to Connick, the leading Supreme Court case considering 24 municipal liability for prosecutorâs later-discovered Brady violation. 1 Plaintiffs seek to impose liability upon Defendants for the singular act of an employee, 2 which in this circumstance allegedly violated Plaintiffsâ constitutional rightsâi.e. respondeat 3 superior. This runs counter to decades of precedent and fails as a matter of law. See Waggy v. 4 Spokane Cnty. Washington, 594 F.3d 707, 713â14 (9th Cir. 2010) (summary judgment 5 appropriate where plaintiff âpoints us to no express county policy or custom, and he provides no 6 evidence showing even an inference that such a procedure existsâ). 7 IV. CONCLUSION 8 Accordingly, and having considered Defendantsâ motion, the briefing of the parties, and 9 the remainder of the record, the Court finds and ORDERS that Defendantsâ Motion for Summary 10 Judgment Pursuant to Fed. R. Civ. P. 56. (Dkt. #40) is GRANTED. Plaintiffsâ Motions in Limine 11 (Dkt. #49) are DENIED as moot. Plaintiffsâ claims are DISMISSED with prejudice.
