1 WO 2 3 4 5 6 IN THE UNITED STATES DISTRICT COURT 7 FOR THE DISTRICT OF ARIZONA 8 9 Michele Martinez, No. CV-24-02741-PHX-ROS 10 Plaintiff, ORDER 11 v. 12 State of Arizona, et al., 13 Defendants. 14 15 Plaintiff Michele Martinez (âPlaintiffâ) filed this action against the State of Arizona, 16 Karen Peters in her official capacity as the Director of the Arizona Department of 17 Environmental Quality (âADEQâ), and four former or current ADEQ employeesâLaura 18 Malone, Sowjanya Chintalapati, Leslie Pehoua, and Michael Keyack (âIndividual 19 Defendantsâ) (collectively âDefendantsâ) alleging state and federal employment 20 discrimination claims and a claim under 42 U.S.C. § 1983 for violation of Plaintiffâs 21 constitutional rights. (Doc. 1-5, âCompl.â). Defendants seek dismissal of the § 1983 claim 22 (Count V) against all Defendants, except for the First Amendment retaliation claim against 23 Defendant Malone. (Doc. 6, âMot.â). Plaintiff responded (Doc. 7, âResp.â), and 24 Defendants replied (Doc. 10, âReplyâ). For the reasons set forth below, the motion will 25 be granted as to the Fourteenth Amendment due process claim and denied as to the First 26 Amendment retaliation claim. 27 I. BACKGROUND 28 In her Complaint, Plaintiff alleges the following facts relevant to the claims subject 1 to the instant motion. Plaintiff began working at ADEQ 2018 as an Administrative Service 2 Officer. (Compl. ¶ 10). During her tenure, Plaintiff reported âunethical and illegal 3 conductâ related to âviolations of the procurement code and matters involving sharing of 4 proprietary software of an existing vendorâ on the part of certain ADEQ employees (Id. ¶ 5 13, 15, 16). Once ADEQ became aware of the reporting, Plaintiff alleges she was unfairly 6 reprimanded in the manner that follows. (Id. ¶ 20). 7 At some point, Defendants Keyack and Pehoua lowered her score on her 8 performance evaluation despite that they never supervised her. (Id. ¶ 14). On April 26, 9 2023, Defendant Malone verbally reprimanded Plaintiff for being âsnippy and 10 argumentativeâ at a team meeting the previous day. (Id. ¶ 26). On August 17, 2023, 11 Defendant Chintalapati advised Plaintiff she was no longer the project manager for the Tier 12 II Project for MyDEQ, effective immediately. (Id. ¶ 29). And on September 8, 2023, 13 Plaintiff was called into a meeting with Defendants Malone and Pehoua where she received 14 a letter of reprimand for inappropriate and unprofessional behavior during various meetings 15 between April 2023 and July 2023. (Id. ¶ 30). According to Plaintiff, receiving this 16 discipline has rendered her ineligible for âvarious positions and financial increases with 17 the State of Arizona.â (Id. ¶ 31). 18 II. MOTION TO DISMISS 19 A complaint must set forth a âshort and plain statement of the claim showing that 20 the pleader is entitled to relief.â Fed. R. Civ. P. 8(a)(2). âTo survive a motion to dismiss, 21 a complaint must contain sufficient factual matter, accepted as true, to âstate a claim to 22 relief that is plausible on its face.ââ Ashcroft v. Iqbal, 556 U.S. 662, 678 (2009) (quoting 23 Bell Atl. Corp. v. Twombly, 550 U.S. 544, 555 (2007) (internal citations omitted)). If âthe 24 well-pleaded facts do not permit the court to infer more than the mere possibility of 25 misconduct, the complaintâ has not adequately shown the pleader is entitled to relief. Id. 26 at 679. Although federal courts ruling on a motion to dismiss âmust take all of the factual 27 allegations in the complaint as true,â they âare not bound to accept as true a legal 28 conclusion couched as a factual allegation.â Id. at 678 (quoting Twombly, 550 U.S. at 555) 1 (internal quotations omitted). 2 Defendants argue Count V should be dismissed against all Defendants except for 3 the First Amendment retaliation claim against Defendant Malone because (1) Plaintiff 4 failed to state a Fourteenth Amendment procedural or substantive due process claim and 5 (2) Plaintiff failed to state a First Amendment retaliation claim against Defendants 6 Chintalapati, Pehoua, and Keyack. As a preliminary matter, Defendants moved, and 7 Plaintiff agreed, to dismiss the State of Arizona from Count V and Defendant Peters from 8 the lawsuit.1 (Resp. at 1). The Court will thus dismiss the parties and analyze Defendantsâ 9 remaining arguments. 10 A. Fourteenth Amendment Due Process 11 Defendants argue Plaintiffâs Fourteenth Amendment substantive and procedural due 12 process claim fails because (1) the actions alleged do not âshock the conscienceâ and (2) 13 Plaintiff has not identified an applicable property because she was an at-will employee. 14 Plaintiff responds that (1) an evaluation of whether the actions alleged âshock the 15 conscienceâ is an inappropriate factual determination and (2) Arizona state employment 16 rules confer Plaintiff a property interest in continued employment despite her at-will status. 17 The Court agrees with Plaintiff that a determination of whether the actions alleged âshock 18 the conscienceâ is factually dense and thus inappropriate at this stage. However, because 19 Plaintiff has not alleged a property interest in continued employment, the Court will grant 20 Defendantsâ Motion as to the Fourteenth Amendment claim. 21 The Fourteenth Amendment of the U.S. Constitution provides that no State shall 22 âdeprive any person of life, liberty, or property, without due process of law.â The Due 23 Process Clause provides procedural protections and it also âincludes a substantive 24 component that âprovides heightened protection against government interference with 25 certain fundamental rights and liberty interests.ââ Troxel v. Granville, 530 U.S. 57, 65 26 (2000) (quoting Washington v. Glucksberg, 521 U.S. 702, 720 (1997)). A procedural due 27 process violation has two elements: â(1) a deprivation of a constitutionally protected liberty 28 1 Neither a state or an official acting in her individual capacity is a âpersonâ for purposes of § 1983. Depât of State Police, 491 U.S. 58, 71 (1989). 1 or property interest, and (2) a denial of adequate procedural protections.â United States v. 2 101 Houseco, LLC, 22 F.4th 843, 851 (9th Cir. 2022) (quoting Brewster v. Bd. of Educ. of 3 Lynwood Unified Sch. Dist., 149 F.3d 971, 982 (9th Cir. 1998)). 4 The Due Process analysis involves a two-step process: (1) determining whether 5 Plaintiff had a protected property interest in her continued employment and (2) determining 6 whether, in being deprived of this interest, she received all the process that was due. 7 Clements v. Airport Authority of Washoe Cnty., 69 F.3d 321, 331 (9th Cir. 1995). Property 8 interests are created by âexisting rules or understandings that stem from an independent 9 source such as state lawârules or understandings that secure certain benefits and that 10 support claims of entitlement to those benefits.â Brewster, 149 F.3d at 982. â[T]he Courtâs 11 determination that [Plaintiff] was an at-will employee negates the existence of a property 12 interest in [her] employment.â Clements, 69 F.3d at 331 (citing Board of Regents v. Roth, 13 408 U.S. 564 (1972)). 14 Under A.R.S. 41-742(A)(1), beginning in 2012, all new hires in the Arizona State 15 Personnel System âare at will uncovered employees.â Plaintiff was hired by ADEQ in 16 2018. (Compl. ¶ 10). And she admits she is an at-will employee. (Resp. at 8). Plaintiff 17 argues her at-will status does not preempt finding a property interest through her 18 interpretation of the Arizona Administrative Code. Plaintiffâs interpretation, however, is 19 misguided. Ariz. Admin. Code § 2-5A-801(C)(2)(b) states that an uncovered (at-will) 20 employee cannot become a covered employee through an involuntary demotion. Instead 21 of creating a property interest, the Code reasserts that âan uncovered employee serves at 22 the pleasure of the appointing authority and may be dismissed at will.â Ariz. Admin. Code 23 § 2-5A-801. Thus, Plaintiffâs due process claim fails, and will be dismissed with prejudice. 24 B. First Amendment Retaliation 25 A First Amendment retaliation claim requires Plaintiff to allege (1) she engaged in 26 constitutionally protected activity (2) the result of which subjected her to adverse action by 27 an Individual Defendant that would chill a person of ordinary firmness from continuing to 28 engage in the protected activity, (3) substantially causing the adverse action. Blair v. Bethel 1 Sch. Dist., 608 F.3d 540, 543 (9th Cir. 2010) (citing Pinard v. Clatskanie School Dist. 6J, 2 467 F.3d 755, 770 (9th Cir. 2006)). Speech is constitutionally protected at step one if it 3 involves a matter of public concern and âthe employeeâs interest in expressing [herself] 4 must outweigh the Stateâs interests in promoting workplace efficiency and avoiding 5 workplace disruption.â Brewster, 149 F.3d at 978. â[F]or adverse, retaliatory actions to 6 offend the First Amendment, they must be of a nature that would stifle someone from 7 speaking out.â Blair, 608 F.3d at 544 (explaining that the most common adverse actions 8 are punishments that are âregulatory, proscriptive, or compulsory in nature,â such as loss 9 of a job, loss of a license, or accusations of criminal activity) (citing Laird v. Tatum, 408 10 U.S. 1, 11, (1972)). 11 Plaintiff alleges that she was unfairly reprimanded for asserting that, in her view, 12 the contract for a new software program that ADEQ was implementing violated Arizona 13 procurement law and the legacy software providerâs intellectual property rights. (Compl. 14 ¶¶ 15-20). Defendants concede that Plaintiffâs allegations may be sufficient to state a First 15 Amendment retaliation claim against Defendant Malone because she alleges Defendant 16 Malone verbally reprimanded her and signed the Letter of Reprimand. (Id. ¶¶ 26, 30). 17 However, Defendants challenge the sufficiency of Plaintiffâs allegations against 18 Defendants Chintalapati, Pehoua, and Keyack. The Court finds Plaintiff has sufficiently 19 alleged a retaliation claim against all Individual Defendants. 20 In her Complaint, Plaintiff alleges â[h]er score on her evaluation was lowered by 21 Defendants Keyack and Pehoua despite them never supervising herâ following Plaintiffâs 22 reporting of alleged âunethical and illegal conductâ by ADEQ employees, including the 23 Individual Defendants. (Compl. ¶ 13-14, 16). âA negative performance evaluation may 24 constitute an adverse employment action.â Hooks v. Lockheed Martin Skunk Works, 14 25 Fed. Appx. 769, 772 (9th Cir. 2001). Plaintiffâs allegations against Defendants Keyack 26 and Pehoua are specific relevant facts which sufficiently state a retaliation claim. 27 Similarly, Plaintiff alleged âDefendant Chintalapati advised [Plaintiff] during an 28 emergency meeting that effective immediately she was no longer the project manager for 1 || the Tier II Project for MyDEQ.â (Compl. 4 29). The Court finds this allegation sufficiently || states a material adversity such that it may likely deter a reasonable worker from making a 3|| charge. See Pearson v. Reynolds Sch. Dist. No. 7, 998 F. Supp. 2d 1004, 1024 (D.
